MPs can only vacate seats upon changing political identity – Supreme Court

Ghana’s Supreme Court has clarified the grounds for Members of Parliament (MPs) vacating their seats (vacate seats). In a landmark ruling supporting Majority Leader Alexander Afenyo-Markin’s suit, the court stated that an MP’s seat is only considered vacated if they change their political affiliation and remain in Parliament under the new identity.

The court emphasized understanding these provisions within the current parliamentary term’s context, excluding future electoral intentions or candidacies. This ruling provides clarity on the constitutional grounds for MPs vacating their seats in Ghana.
